1) Scope of Application

1.1

These General Terms and Conditions (hereinafter “GTC”) of MISK AMOUR (hereinafter “Seller”) apply to all contracts for the delivery of goods concluded between a consumer or business customer (hereinafter “Customer”) and the Seller with respect to the goods displayed in the online shop.

The inclusion of any terms and conditions of the Customer is hereby excluded unless expressly agreed otherwise.

1.2

For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.

A business customer is a natural or legal person, or a partnership with legal capacity, who acts in the course of their commercial or independent professional activity when entering into a legal transaction.

2) Conclusion of Contract

2.1

The product descriptions contained in the Seller’s online shop do not constitute binding offers, but are intended to enable the Customer to submit a binding offer.

2.2

The Customer may submit an offer via the Seller’s online order form. By clicking the button that completes the ordering process, the Customer submits a legally binding contractual offer.

2.3

The Seller may accept the Customer’s offer within five days by either sending an order confirmation, delivering the goods, or requesting payment from the Customer. If several of these options apply, the contract is concluded as soon as one of these conditions is fulfilled.

2.4

Payment processing is carried out, depending on the Customer’s selection, via PayPal or other payment methods offered by the Seller.

2.5

The text of the contract is stored after conclusion of the contract and made accessible to the Customer. Customers with a user account can view their order details.

2.6

The contract is concluded exclusively in German.

3) Right of Withdrawal

3.1

Consumers generally have a right of withdrawal unless the products are hygiene-sensitive products.

3.2

Due to applicable hygiene requirements, products from MISK AMOUR are not subject to a right of withdrawal. All products are excluded from exchange and return, unless the goods are defective or damaged.

3.3

In such cases, please contact us immediately so that we can find an appropriate solution. No further rights of return apply.

4) Prices and Payment Terms

4.1

All prices stated are final prices and include the applicable statutory VAT. Shipping costs are stated separately.

4.2

For deliveries to countries outside the European Union, additional costs such as customs duties may apply.

4.3

Various payment methods are available to the Customer, as indicated in the online shop.

5) Delivery and Shipping Terms

5.1

Delivery will be made to the delivery address provided by the Customer.

5.2

If a shipment is returned due to an incorrect address provided by the Customer, the Customer shall bear the resulting costs.

6) Retention of Title

The Seller retains ownership of the goods until the purchase price has been paid in full.

7) Liability for Defects (Warranty)

The statutory warranty rights apply.

8) Alternative Dispute Resolution

9) VAT and Import Duties

The Customer is responsible for any applicable import duties and VAT in the destination country.

10) Transportation of Goods to the Consumer

The contract becomes effective upon completion of the purchase process. The goods will be transported after the contract has been concluded.

11) Organization of Transportation

Delivery is carried out by an external shipping service provider.

12) Disclaimer of Liability

MISK AMOUR acts as the Seller and assumes no liability for the quality or condition of the goods, as these are manufactured and shipped by third parties.

13) VAT

In some countries, VAT may subsequently be charged on products.
